Terms of Use
Effective date: July 30, 2026. These Terms of Use govern access to and use of the Nearest Deal app, website, and related services.
1. Acceptance of Terms
By accessing or using Nearest Deal, you agree to be bound by these Terms of Use, our Privacy Policy, and any additional policies posted within the service. If you do not agree, do not use the service.
2. Nature of the Service
Nearest Deal is a listing, discovery, alert, and connection platform only. We provide tools that help users post listings, find listings, receive alerts, and connect with one another. We are not the seller, buyer, reseller, broker, auctioneer, shipper, escrow provider, payment agent, inspector, authenticator, guarantor, or insurer of any item, service, or transaction advertised through the platform.
3. No Endorsement or Verification
We do not guarantee that any listing is accurate, lawful, safe, genuine, available, merchantable, fairly priced, or suitable for your needs. We do not guarantee the identity, honesty, quality, credibility, conduct, solvency, or intentions of any user. Any verification feature, moderation control, or alert mechanism is limited and should not be treated as a warranty, endorsement, or certification.
4. User Responsibility and Risk
- You are solely responsible for all listings, messages, images, profile content, and actions taken through your account.
- You are solely responsible for your own due diligence before paying, meeting, exchanging goods, sharing information, or completing any transaction.
- You assume all risk relating to fraud, cybercrime, phishing, impersonation, scams, theft, defective goods, unlawful goods, unsafe meetings, misrepresentation, price manipulation, delivery failure, payment failure, and personal or financial loss.
- You should independently verify products, people, prices, ownership, legality, and safety before acting.
5. Prohibited Conduct
You agree not to:
- Post unlawful, misleading, harmful, abusive, infringing, obscene, or fraudulent content.
- Use the platform to scam, deceive, threaten, stalk, harass, or impersonate others.
- Bypass our payment or contact access systems where such systems apply.
- Post prohibited goods, stolen goods, counterfeit goods, unsafe goods, or content that violates applicable law.
- Attempt unauthorized access, scraping, reverse engineering, or automated abuse of the service.
6. Fees, Passes, and Paid Features
Paid features such as featured listings, contact access, subscriptions, seller shop options, and other platform benefits are subject to the terms shown at the point of purchase. Unless required by law or platform policy, fees are generally non-refundable once the purchased digital benefit has been granted or consumed.
Any amount charged by Nearest Deal is only for listing products or services, platform visibility, subscriptions, or providing contact information and related digital platform benefits. Such payments are not payments for the underlying product or service shown in a listing. Buyers and sellers must manage all product or service payments directly with each other and offline from the platform.
If a paid feature is billed through Google Play, the user-facing purchase flow, price, cancellation mechanics, renewal mechanics, and refund handling may be governed in part by Google Play rules and the Google Play billing interface shown to the user at checkout. Users should review the Google Play purchase screen carefully before completing a transaction.
7. Refunds, Cancellations, and Renewal
Nearest Deal provides an in-app refund-review request for qualifying Google Play purchases. A request may be submitted within 48 hours of the recorded purchase only when none of the purchased digital benefits have been activated or consumed. Submission starts a review; it is not an automatic refund approval or confirmation that Google Play has cancelled a subscription.
- Subscriptions may renew automatically unless cancelled through Google Play before the renewal date.
- Subscription renewal must be managed through Google Play. Cancelling future renewal does not itself refund a completed charge.
- Users may also submit an eligible request directly through Google Play under Google Play's own refund process and timelines.
- Nearest Deal verifies the purchase, request time, entitlement usage, Google Play status, and applicable consumer rights before deciding a request.
- One-time digital benefits such as contact unlocks, listing bumps, or featured boosts are generally treated as consumed or granted once the digital benefit is activated, unless applicable law requires otherwise.
- Duplicate charges and successful payments where the purchased digital benefit was not granted will be investigated and reconciled.
- If a verified Nearest Deal technical failure cannot be corrected, the remedy may be a replacement benefit, restored credit, extension of a time-limited benefit, or refund as appropriate.
- Failed or fallback AI provider attempts must not consume a paid AI credit.
- Nothing in these Terms limits any non-waivable consumer rights that apply in the user’s country of residence.

8. Listings, Availability, and Ordering
We may rank, sort, filter, highlight, suppress, pause, disable, expire, reject, or remove listings and accounts at our discretion, including for moderation, policy enforcement, security, abuse prevention, legal reasons, system integrity, or product quality reasons.
9. Intellectual Property
The Nearest Deal platform, branding, software, and related materials are owned by Nearest Deal or its licensors. You retain rights in your own content, but by posting content you grant us a non-exclusive license to host, use, display, adapt, reproduce, and distribute it as reasonably needed to operate, market, moderate, and improve the service.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the service is provided on an "as is," "as available," and "with all faults" basis. We disclaim all warranties of any kind, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security, quiet enjoyment, and results.
11. Limitation of Liability
To the maximum extent permitted by law, Nearest Deal and its owners, operators, affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, goodwill, data, property, opportunity, or business, arising out of or relating to your use of or inability to use the service, any listing, any user interaction, any transaction, any fraud, any cyber incident, any defective or unlawful item, or any third-party conduct, even if we were advised that such damages were possible.
To the maximum extent permitted by law, our total aggregate liability for any claim relating to the service will not exceed the amount you paid directly to Nearest Deal for the specific paid feature or service that gave rise to the claim during the twelve months before the event giving rise to the claim. If you did not pay us for the relevant feature or service, our aggregate liability will be zero to the fullest extent permitted by law.
Nearest Deal is represented and owned by Scan Technology L.L.C. Scan Technology L.L.C and the Nearest Deal platform cannot be held accountable for fraud, misuse, failed transactions, delivery issues, payment disputes, impersonation, or loss arising from interactions between users.
12. Complaints and User Support
Questions, complaints, suspected fraud reports, content complaints, account issues, and billing concerns may be sent to support@nearestdeal.com. Valid support requests receive an initial human response within one business day. Where local law requires specific complaint-handling rights or escalation paths, those rights remain available to the user in addition to contacting us directly.

13. Indemnity
You agree to defend, indemnify, and hold harmless Nearest Deal and its owners, operators, affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, losses, damages, liabilities, judgments, settlements, costs, and expenses, including reasonable legal fees, arising out of or relating to your content, your listings, your transactions, your use of the service, your violation of law, or your breach of these Terms.
14. Suspension and Termination
We may suspend, restrict, or terminate access to the service at any time, with or without notice, if we believe it is necessary to protect users, the platform, third parties, or our business interests.
15. Changes to the Service or Terms
We may modify the service and these Terms from time to time. Updated Terms become effective when posted. Continued use after changes become effective means you accept the revised Terms.

Nearest Deal does not contact users asking them to pay service fees, commissions, verification charges, or any other off-platform payment. Treat any such request as suspicious and report it immediately.
